Certification for e-Meetings

An e-meeting pursuant to the Emergency Decree on Electronic Meetings B.E. 2563 (A.D. 2020) is a meeting decreed by law to take place via electronic media whereby attendees are not in the same place and may meet, consult, discuss and exchange opinions via electronic media.

Certification Enforcement and Legal Effects

• This certification can be used for meetings with need for legal effects or legally-required meetings such as shareholder meetings or committee meetings.
• The certification can be used for meetings in the government sector and the private sector.

Certification is not enforced upon the following:

• Meetings of the House of Representatives, the Senate and Parliament.
• Meetings to prepare court verdicts or orders.
• Meetings to comply with procurement processes of government agencies, local governments, state enterprises, public organizations and other government organizations.
• Other meetings or meetings on topics specified in ministerial regulations.

Organizing e-Meetings with Legal Impact:

• Arrangements must be made to enable attendees to identify themselves before joining the meeting.
• Arrangements must be made to enable attendees to vote openly and secretly.
• Minutes of meetings must be prepared in writing (minutes of meetings may be prepared in electronic formats).
• Arrangements must be made to make audio recordings or audio and video recordings, depending on the case, of every attendee throughout the duration of the e-meeting except in the case of secret meetings.
• Electronic traffic data of every attendee must be stored as evidence.
• e-Meetings must be consistent with standards for maintaining e-meeting security prescribed by the Ministry of Digital Economy and Society.

Security standards are prepared by the ETDA under the Ministry of Digital Economy and Society Notification re: Standards of Maintaining Security of Meetings via Electronic Means B.E. 2563 (A.D. 2020) offsetting out the main principles of information security. Service providers are required to comply with security requirements related to electronic meetings at the aforementioned standards.

"e-Meeting system certification is a path toward building confidence in using meeting control systems. In addition to independently considering consistency with standards, service providers who wish to increase reliability of meeting control system services can apply for the ETDA to assess and certify consistency of systems used by service providers to provide services. Currently, e-meeting system consistency assessment and certification can be achieved in the following two ways:

1. Self-assessment by e-meeting service providers by sending assessment forms to the ETDA to check and determine if service providers perform self-assessment of meeting control system with an understanding of consistency with requirements. In this case, the ETDA will deploy assessors to assess e-meeting systems on the website.
2. System consistency certification by the ETDA. e-Meeting system service providers can state the intention to request an assessment in assessment rounds announced by the ETDA. "
